CLUB BOTÁNICO ROSA MARÍA, referred to as “THE RESPONSIBLE PARTY,” is responsible for your data’s processing, use, and protection. Please be informed that the information, images, and sounds will be treated strictly confidentially and solely for the purposes of THE RESPONSIBLE PARTY and its relationships with its members. Therefore, it will be necessary to provide them to “THE RESPONSIBLE PARTY” when required for the services and/or products provided, developed, or delivered by it, as well as to inform you about requests, service statuses, promotions, and changes in this policy.

PERSONAL DATA: The Personal Data that we require from the Data Subject may consist, in an enumerative but not limited manner, of the following: name(s), surnames, date of birth, place of birth, home address and/or office address and/or fiscal address, landline and/or mobile phone, email, nationality, gender, marital status, occupation, federal taxpayer registry, unique population registry key, education, academic degree, professional license number, specialty, postgraduate studies, master’s degree, doctorate, university or school where the specialization, postgraduate studies, master’s degree, or doctorate was obtained, credit or debit card number for donations and/or contributions, name of the banking institution, expiration date of the credit or debit card, branch number, bank account number, interbank CLABE number for deposits, among others. Sensitive Personal Data may include racial or ethnic origin, present or future health status, genetic information, religious, philosophical, and moral beliefs, union affiliation, political opinions, or sexual preference.

PROCESSING AND PURPOSE OF PERSONAL DATA: (i) identification data; (ii) contact data; including (iii) Sensitive Personal Data of the “Data Subject” that, voluntarily and expressly, is provided to THE RESPONSIBLE PARTY will have as main purposes, the following, depending on the case: identification, location, and contact; registration of entry and exit from the facilities; registration in various databases depending on their nature, either as a contact, visitor, supplier, provider of professional services, lessor, lessee, sublessor, sublessee, beneficiary, donor, sponsor, provider of social service or professional practices, volunteer, worker; preparation of contracts, agreements, commitments, letters of responsibility, commitment letters, or any other document; preparation and integration of files depending on their nature; verification of the Data Subject’s information; filling out forms and/or documents; providing the services, products, and information requested; integration and, where appropriate, updating of a Telephone Directory of suppliers, providers of professional services, lessors, lessees, sublessors, sublessees, beneficiaries, sponsors, donors, volunteers, among others; sending physical or electronic correspondence; generation of a list of beneficiaries, sponsors, donors, or volunteers, as the case may be; for study, analysis, and research purposes, filling out authorization for image use; issuance of the Digital Tax Receipt (CFDI) corresponding; for payment purposes; to verify the Data Subject’s information; sending information to the Data Subject by THE RESPONSIBLE PARTY or by governments or companies that support THE RESPONSIBLE PARTY, for filling out general data and identification forms of Beneficiary Owner or Controlling Beneficiary, for the integration of the unique file as well as for the identification and/or sending of notices in compliance with the Federal Law for the Prevention and Identification of Operations with Illicit Origin Resources as well as for their transfer to third parties if strictly necessary; and will have the following secondary purposes: preparation of any document; generation of reports and information, statistical and promotional purposes as well as communication about changes in services and/or products.

COLLECTION, HANDLING, AND USE OF WEB DATA: “THE RESPONSIBLE PARTY” may collect data through its websites or the use of automatic data capture tools. These tools allow collecting the information your browser sends to such websites, such as the type of browser you use, user language, access times, and the IP address of websites you used to access “THE RESPONSIBLE PARTY’s” sites, among others.

Among the automatic data capture tools used on our websites and web pages are cookies, web beacons, and URLs shared by email.

Use of Cookies: The correct functioning of “THE RESPONSIBLE PARTY’s” sites requires enabling “cookies” in your Internet browser. “Cookies” are small data files transferred by the website to your computer’s hard drive when you browse the site. Use of Web Beacons: Also known as Internet tags, pixel tags, and clear GIFs, The Association may use web beacons on its websites and in its HTML-formatted emails, alone or in combination with cookies, to collect information about website usage and interaction with email. The web beacon is an electronic image, called a single-pixel (1×1) or GIF that can recognize information processed on your computer, such as cookies, the time and date when the site and its sections are viewed.

URLs in “THE RESPONSIBLE PARTY’s” emails: Emails may include URLs that allow “THE RESPONSIBLE PARTY” to know if you activated such URL and visited the destination webpage, this information may be included in your profile. Likewise, they may include links designed to direct you to relevant sections of the websites, by redirecting you through “THE RESPONSIBLE PARTY’s” servers, the redirection system allows for determining the effectiveness of online marketing campaigns.

Protection of minors, and people under interdiction or disability: We encourage parents and guardians to take an active role in their children’s or represented persons’ online activities. In case you believe that personal data has been provided by a minor or by a person under interdiction or disability, in contravention of this Privacy Notice, please send an email to the address: [email protected] so that we can proceed to delete such personal data promptly.

DATA TRANSFER: “THE RESPONSIBLE PARTY” may transfer all personal data to third parties within and outside the country, for similar or different purposes, for qualitative, quantitative, quality, commercial, and any other effects without limitation in this regard; therefore, the Data Subject accepts that “THE RESPONSIBLE PARTY” may transfer their Personal Data and/or Sensitive Personal Data to any third party,  legal name, national or foreign, or to government agencies or entities, with THE RESPONSIBLE PARTY having the obligation to inform them of the content of this Privacy Notice as well as the purposes to which the processing of such data was subject, with the understanding that the receiving third party will assume the same obligations as “THE RESPONSIBLE PARTY”. The opposition by the Data Subject must be express and duly notified to “THE RESPONSIBLE PARTY”, by any of the means indicated in this notice; otherwise, it will be considered tacitly accepted.

MODIFICATIONS: “THE RESPONSIBLE PARTY” reserves the right to change and update this privacy notice at any time, to address novelties. It must notify this by a simple notice displayed to the public in general and posted in the offices, locations, websites, or any efficient means of communication of “THE RESPONSIBLE PARTY”.

ARCO RIGHTS: The Data Subject may exercise their rights of access, rectification, cancellation, or opposition (ARCO), or revoke their tacit consent through the procedures that we have implemented and that can be known by contacting THE RESPONSIBLE PARTY via email at [email protected], in which they must submit a written document containing the following information:

I. Name of the Data Subject and address, telephone, email, and any other means to communicate the response to their request; II. Valid documents proving their identity (simple copy in printed or electronic format of their voter ID, passport, or FM2 or FM3 Visa) or, where appropriate, the legal representation of the Data Subject (simple copy in printed or electronic format of the simple power of attorney with the autograph signature of the Data Subject, the agent, and their corresponding valid official identifications: voter ID, passport, or FM2 or FM3 Visa); III. A clear and precise description of the data regarding which they seek to exercise any of the ARCO Rights, and IV. Any other element or document that facilitates the location of the Data Subject’s data.

In the case of requests for rectification of personal data, the Data Subject must also indicate the modifications to be made and provide the documentation supporting their request.

To comply with the obligation to access their personal data, it will be provided after accrediting the identity of the Data Subject or the personality of the representative; making the information available on-site at the responsible party’s address. Another means may be agreed upon between the Data Subject and the responsible party as long as the requested information allows it.

“THE RESPONSIBLE PARTY” will respond to the Data Subject within a maximum period of twenty business days, counted from the date the request was received, so that, if it is appropriate, it can be effective within the following fifteen business days after communicating the response. In all cases, the response will be given by the same means through which the request was submitted or, where appropriate, by any other means agreed upon with the Data Subject. The aforementioned deadlines may be extended in terms of the Law.

If you believe that your right to the protection of Personal Data has been violated by any conduct of our employees or our actions or responses or, consider that there is a violation of the provisions of the Federal Law on Protection of Personal Data Held by Private Parties in the processing of your Personal Data, you may file the corresponding complaint or report with the Federal Institute of Access to Information and Data Protection (IFAI).
